DriveTestIQ is an independent study platform. Our practice questions are original and are written from public driving law. DriveTestIQ is independently operated and is not connected to any government agency or motor vehicle department.

DriveTestIQ is a study tool. It provides original practice questions and learning features written from public driving law to help you prepare for a driver knowledge test. The Service is for educational and informational purposes only. It is not the official examination, is not legal advice, is not driving instruction, and is not a substitute for the law itself or for any government agency’s materials, testing, or licensing process.

You must be at least 13 years old to use the Service and at least 18 years old (or have the consent and supervision of a parent or legal guardian who agrees to these Terms) to make a purchase. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

Some features require an account, which is created using your email address and a one-time sign-in link. You are responsible for maintaining access to the email associated with your account and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization.

Full access to a state’s question bank is sold as a one-time purchase that unlocks a defined access window for that state (for example, a 7-day or 30-day window, as described at the point of sale). Purchases are not subscriptions; they do not auto-renew and you will not be charged again unless you make a new purchase. Access is digital and is granted immediately after successful payment. Prices, access windows, and included features are those shown at the time of purchase and may change for future purchases. Payment is processed by our third-party payment processor, Stripe; we do not receive or store your full card details.

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

We do not and cannot guarantee that you will pass any test, obtain any license, or achieve any particular score. Test outcomes depend on many factors outside our control, including your own study, the official examination, and the policies of the relevant government agency. Any study aids, progress tracking, or practice results we provide are estimates for learning purposes only.

Pass Guarantee. If you purchase full access to a state’s question bank, take that state’s official written test, and do not pass, you may request a one-time renewal of your access at no additional charge. To qualify, you must email us proof that you took and did not pass the official test, and your request must be sent within 30 days of your test date. When approved, the renewal matches the access window you purchased (for example, 7 days or 30 days) and is granted once per purchase.

The Pass Guarantee provides additional study time only. It is not a guarantee of a passing result, and it is not a refund of your purchase. Refunds remain governed by our Refund Policy. We may reasonably verify a claim before granting a renewal.

You agree that you will not, and will not attempt to:

• copy, reproduce, scrape, harvest, mirror, republish, sell, sublicense, or otherwise redistribute the questions, explanations, translations, or other content of the Service;
• use any robot, spider, scraper, automated script, or other automated means to access or extract content from the Service;
• share, resell, or provide access to your account or purchased content to any other person;
• circumvent, disable, or interfere with security, access-control, rate-limiting, or usage features of the Service;
• reverse engineer, decompile, or attempt to derive the source code or underlying data of the Service except to the limited extent that applicable law permits despite this restriction; or
• use the Service for any unlawful purpose or in violation of these Terms.

The Service and all of its content — including the practice questions, answer explanations, translations, text, design, graphics, logos, and software — are owned by DriveTestIQ or its licensors and are protected by intellectual-property and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and the content you have purchased solely for your own personal, non-commercial study. No other rights are granted. All rights not expressly granted are reserved.

We rely on third-party providers to operate the Service, including Stripe (payment processing), Supabase (accounts and database), Vercel (hosting), Resend (email delivery), and Cloudflare (security and content delivery). Your use of the Service may be subject to those providers’ terms. We are not responsible for the acts or omissions of third-party providers.

We work to keep our questions accurate and grounded in current public driving law, but laws change and errors are possible. The Service is provided for study only and may contain inaccuracies. We may add, modify, suspend, or discontinue any part of the Service at any time.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS CONTENT IS COMPLETE OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVETESTIQ AND ITS OWNERS, OPERATORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR THE FAILURE TO PASS ANY TEST OR OBTAIN ANY LICENSE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless DriveTestIQ and its owners, operators, and providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service. You may stop using the Service at any time and may delete your account from your account page. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.

From time to time DriveTestIQ may offer a free-access study program for a defined group and a limited period. The California Retest Relief Program provides eligible California drivers free access to the full California question bank under these conditions:

• You may apply if you received a California notice requiring you to retake the written knowledge test.
• Access is limited to one grant per person and provides 30 days of access.
• Access has no cash value and may not be transferred, sold, or resold.
• No payment is required and the access does not renew automatically.
• DriveTestIQ may reject fraudulent or duplicate applications and may revoke access for abuse.
• Program capacity may be limited, and the program may close once capacity or its published deadline is reached.
• The program is a study benefit and does not guarantee that you will pass any test.
• DriveTestIQ is independent and is not connected to any government agency or motor vehicle department. Normal paid access remains governed by the rest of these Terms.

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
